Even though that Banck-FAM Genealogy is NOT a commercial website, Banck-FAM Genealogy acknowledge and respects the European Unions ( the EU ) and United States of America ( the USA ) guidelines and principals regarding Safe Harbor arrangements for personal data transfers ( for the EU and for the USA ).

ABOUT

The Banck-FAM Genealogy is a PHP-based searchable genealogical relations database focusing on southern Sweden and Denmark (Scandinavia) - especially maritime family lineages. Other researchers are invited to supply their findings in sepperate files to do comparativ searches. These other files are limited in access as requested by the individual researcher and to be viewed by others has comply totaly with the conditions stated here below.

Banck-FAM Genealogy was founded by Erik O. Banck (hereafter: "me" and "my") in November 2003, as a part of my interest for both general history, maritime history and my family's history, and became a private non-discriminating, non-political, non-racial, non-religious non-commercial and non-financial Internet Service (hereafter: "service") solely owned, financed and operated by me in November 2006. The web domain for Banck-FAM Genealogy (www.banckfam.org) is registered and is owned by me, and the web site is located in Brussels, Belgium and run by me.

The content and database of Banck-FAM Genealogy is made according to the statutory provisions of the Danish Act on Processing of Personal Data (Act No. 429 of 31 May 2000 - with latest changes), and the main Banck-FAM Genealogy file do not consist of any kind of imported data (such as gedcom-data). All information/data has been - and will be - reviewed and manually typed by me. Banck-FAM Genealogy is made as a part of my interest for both general history and genealogy as well as for my family's history and genealogy. The database structure in Banck-FAM Genealogy is programmed using PHP-5 and PostgreSQL.

If you believe, that any information at Banck-FAM Genealogy is not according to realities, you are very welcome to contact me with the necessary documentation, where after the information will be corrected. You are also very welcome to contact me with your additions, changes and corrections to the database at Banck-FAM Genealogy, as well as with your comments, questions and/or suggestions regarding Banck-FAM Genealogy. TERMS AND CONDITIONS OF USE

"You" or "your" means any adult user of the service for itself and you as parent or guardian for any minor, which you allow to access the service, for who you will be held strictly responsible. Your use of the service indicates that you are bound by this agreement with me. If you do not agree with any of these terms and conditions, do not use the service.

Banck-FAM Genealogy may alter this agreement at my discretion and your continued use after any change indicates your acceptance of that change. For the same reason you are obligated to check this page every time you enter Banck-FAM Genealogy, where you always can read the latest Safe Harbor Statement, and if you do not want to be bound by a change, please do immediately discontinue your use of this service.

Banck-FAM Genealogy contains graphics, information, data, editorial and other content accessible by any Internet user and similar content which is accessible for all users. All content is owned and/or copyrighted by Banck-FAM Genealogy or third party providers and may be used only in accordance with this limited use license. Banck-FAM Genealogy is protected by copyright as a collective work and/or compilation, pursuant to Danish copyright laws, international conventions, and other copyright laws.

LIMITED ALLOWMENT

You are allowed to use the content and database only for personal or professional family history research, and may download content or database elements only as search results relevant to that research you perform. The download of the whole or significant portions of any contents or database elements is prohibited. Resale of any contents or database elements or portion thereof is prohibited. On line or other republication of any content or database elements is prohibited except as unique data elements that are part of a unique family history or genealogy.

Violation of this allowment may result in immediate termination of your use and may result in legal action for injunction, damages or both. You may use access software provided on the service only while on line and may not download, copy, reuse or distribute that software, except where it is clearly stated in connection with software that it is made available for offline use and a license for that use is provided in connection with that software.

USER PROVIDED CONTENT

Portions of the service can contain user provided content, to which you may contribute appropriate content. For this content, Banck-FAM Genealogy is a distributor only. By submitting content to Banck-FAM Genealogy, you grant Banck-FAM Genealogy, the host of the service, a limited allowment to the content to use, host, distribute that content and allow hosting and distribution on co-branded services of that content. You should submit only content which belongs to you and will not violate the property or other rights of other people or organizations.

Banck-FAM Genealogy is sensitive to the copyright and other intellectual property rights of others. Banck-FAM Genealogy reserves the right to remove any user provided content that comes to its attention and that it believes, in its sole discretion, is illegal, obscene, indecent, defamatory, incites racial or ethnic hatred or violates the rights of others.

The information, products, and services included on Banck-FAM Genealogy may include inaccuracies or typographical errors. Changes are periodically added to the information herein. Banck-FAM Genealogy and its third party suppliers provide all content in this service "AS IS", and without any warranty of any kind.

Banck-FAM Genealogy and its third party suppliers make no representations concerning the suitability, reliability or accuracy of the content or the service provided on the service for any purpose. We and our third party suppliers disclaim all warranties, expressed or implied, in connection with the content and the services provided on the service, including conditions of merchantability, fitness for a particular purpose, title and non-infringement. Sites of those third parties may be subject to terms and conditions different from those found here. Banck-FAM Genealogy makes no warranty concerning third party provided goods or services and you agree that any recourse for dissatisfaction or problems with those goods or services will be sought from the third party provider and not from Banck-FAM Genealogy.

Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, this limitation may not apply in part to you.

IF YOU ARE DISSATISFIED WITH ANY PORTION OF THIS WEB SERVICE, OR WITH ANY OF THESE TERMS OF USE, IT IS YOUR SOLE AND EXCLUSIVE REMEDY TO DISCONTINUE USING THIS WEB SERVICE.

IF THERE IS ANY DISAGREEMENT BETWEEN THE DANISH SAFE HARBOR STATEMENT TEXT AND THE ENGLISH SAFE HARBOR STATEMENT TEXT, THEN THE DANISH TEXT STATUTORY, WHILE THE ENGLISH TEXT IS A TRANSLATION OF THE DANISH TEXT.
